2023년 마약류 관리법 위반 혐의로 법정에 섰고, 2023년 1분기 제품총괄책임(CPO) 자리를 내려놨었는데 이후 1심에서 징역형 집행유예를 받고 같은 해 4분기 운영총괄책임자(COO)로 복귀한 바 있다.
김 부사장은 지난해 2025년 7월 병원에서 처방받은 향정신성 약물을 복용한 상태로 서울 강남 일대에서 두 차례 교통사고를 낸 혐의로 기소됐다. 2024년 11월 ‘약물운전’ 혐의로 검찰에 송치됐고, 지난해 2025년 4월 검찰이 불구속 기소했다.
1심에서 집행유예 기간중에 벌어진 일이라 유죄가 될것이란 전망이었는데 결국 무죄 판결을 받았고 검찰은 항소기한 마지막 날인 2025년 12월 3일 전격 항소하면서 2심 재판이 진행 중이다.
집행유예 기간 중 불거진 ‘약물운전’ 의혹은 도덕적 해이를 넘어 TYM 지배구조의 치명적 결함으로 지목된다.
현재 공동대표를 맡은 전문경영인 김도훈 대표 또한 현재 서울남부지검에 주가조작 혐의로 입건된 상태다. 자본시장법 및 외부감사법 위반 혐의 등을 받고 있다. 동시에 국세청의 세무조사가 진행 중인 것으로 알려져 있다.
국세청은 대표 개인의 생활비를 회사 비용으로 처리한 사례로 보고 관련 금액을 비용 부인 조치한 것으로 전해졌다.
업계 관계자는 “이번 주주총회에서 김식 부사장의 재판에 대해 주주들이 어떤 반응을 보일지가 최대 관심사이다”라고 전했다.
Ahead of the annual general meeting of TYM, a company specializing in agricultural machinery, the trial outcome of Vice President Kim Sik—Chairman Kim Hee-yong’s youngest son—is once again drawing controversy.
He stood trial in 2023 on charges of violating the Narcotics Control Act and stepped down from his position as Chief Product Officer (CPO) in the first quarter of 2023. However, after receiving a suspended prison sentence in the first trial, he returned to his role as Chief Operating Officer (COO) in the fourth quarter of the same year.
Vice President Kim was indicted last year in July 2025 on charges of causing two traffic accidents in the Gangnam area of Seoul while under the influence of psychotropic drugs prescribed at a hospital. He was referred to the prosecution in November 2024 on charges of “driving under the influence of drugs,” and the prosecution indicted him without detention in April 2025.
Although the initial outlook was that he would be found guilty in the first trial because the incident occurred during his probation period, he was ultimately acquitted. The prosecution filed an appeal on December 3, 2025, the last day of the appeal period, and the second trial is currently underway.
The “drug-impaired driving” allegations that surfaced during his probation period are seen as more than just a moral lapse; they are identified as a fatal flaw in TYM’s corporate governance.
Kim Do-hoon, a professional manager currently serving as co-CEO, has also been indicted by the Seoul Southern District Prosecutors’ Office on charges of stock price manipulation. He faces allegations of violating the Capital Markets Act and the External Audit Act. At the same time, it is reported that a tax audit by the National Tax Service is underway.
The National Tax Service reportedly identified instances where the CEO’s personal living expenses were treated as company expenses and disallowed the related amounts as deductible costs.
An industry insider stated, “The biggest concern at this shareholders’ meeting is how shareholders will react to the trial of Vice President Kim Sik.”

金副社长被指控于去年2025年7月在服用医院开具的精神类药物后，在首尔江南地区两次引发交通事故。2024年11月，他因“药驾”嫌疑被移送检方，去年2025年4月检方对其提起不羁押起诉。
一审时，由于案件发生在缓刑期间，外界普遍预测其将被判有罪，但最终他被判无罪。检方于上诉期限的最后一天——2025年12月3日——突然提起上诉，目前二审审判正在进行中。
在缓刑期间爆发的“药驾”疑云，不仅被视为道德沦丧，更被指为TYM公司治理结构的致命缺陷。
目前担任联合代表的职业经理人金度勋，现已被首尔南部地方检察厅以操纵股价的嫌疑立案调查。他涉嫌违反《资本市场法》及《外部审计法》等。同时据悉，国税厅的税务调查也在进行中。
据传，国税厅认定其将代表个人的生活费列为公司费用，并已对相关金额采取了不予承认费用的措施。
业内相关人士表示：“本次股东大会上，股东们对金锡副总裁的审判将作何反应，是最大的关注点。”
